DAUPHIN COUNTY JUDGE SUPPRESSES EVIDENCE IN DRUG CASE AGAINST DEFENDANT REPRESENTED BY GEORGE H. MATANGOS, ESQUIRE

In an opinion and order filed on April 10, 2018, Dauphin County, Pennsylvania Judge William T. Tully granted the suppression motion of Brandy Hernandez, who had been charged with possession with intent to deliver drugs, illegal possession of a firearm and drug paraphernalia. The charges stemmed from a dog-fighting investigation undertaken by Harrisburg city police in which her private one-room apartment in a boarding/rooming house was searched without a warrant. Judge Tully, after a suppression hearing and considering judicial precedent, concluded that the police lacked probable cause to conduct a warrantless search of the Defendant’s room. The District Attorney’s Office did not appeal this decision and the charges were subsequently dismissed. Congratulations to the law firm’s George Matangos, Esquire, who represented her.
